By using Personal AI Index ("the Application"), you agree to these Terms and Conditions. If you do not agree, do not use the Application.
2. Description of Service
Personal AI Index is a personal health data management application that allows you to:
- Connect to healthcare providers using SMART on FHIR protocols
- Retrieve and store your health records locally
- Organize and manage your personal health information
3. User Responsibilities
You agree to:
- Provide accurate information when authenticating with healthcare providers
- Keep your login credentials secure and confidential
- Use the Application only for lawful purposes
- Comply with all applicable healthcare data regulations
- Not share your health data access with unauthorized parties
4. Privacy and Data Storage
Local Storage: All health data retrieved by the Application is stored locally on your device. We do not store your health information on external servers.
No Data Transmission: Your health data is not transmitted to Swansons Bespoke Designs or any third parties, except to the healthcare providers you explicitly authorize through OAuth authentication.
Data Control: You maintain full control over your data and can delete it at any time.
5. Healthcare Provider Authorization
The Application requires you to authenticate directly with your healthcare provider using OAuth 2.0. By authorizing the Application:
- You grant the Application permission to access your health records
- You acknowledge that the healthcare provider's privacy policies apply
- You can revoke access at any time through your healthcare provider's patient portal
6. No Medical Advice
IMPORTANT: Personal AI Index is a data management tool only. It does not provide medical advice, diagnosis, or treatment recommendations.
- Always consult qualified healthcare professionals for medical decisions
- Do not rely on the Application for emergency medical situations
- The Application is not a substitute for professional medical care
7. Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of accuracy, completeness, or reliability of health data
- Warranties of uninterrupted or error-free operation
8. Limitation of Liability
Swansons Bespoke Designs shall not be liable for:
- Any direct, indirect, incidental, or consequential damages
- Loss of data or health information
- Medical decisions made based on information in the Application
- Healthcare provider service interruptions or data access issues
- Unauthorized access to your device or data
9. HIPAA Compliance
The Application is designed to help you manage your personal health information. However:
- Swansons Bespoke Designs is not a HIPAA-covered entity or business associate
- The Application does not transmit your data to us
- You are responsible for securing your device and data
- Your healthcare providers remain responsible for HIPAA compliance in their systems
10. Third-Party Services
The Application integrates with third-party healthcare provider systems (such as Epic MyChart). These providers:
- Have their own terms of service and privacy policies
- Control access to their FHIR APIs
- May modify or discontinue API access at any time
11. Intellectual Property
The Application and its original content, features, and functionality are owned by Swansons Bespoke Designs and are protected by international copyright, trademark, and other intellectual property laws.
12. Open Source Components
The Application may include open-source software components, each subject to its own license terms. These components are provided "as is" and their use is governed by their respective licenses.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this website. Continued use of the Application after changes constitutes acceptance of the modified Terms.
14. Termination
You may stop using the Application at any time. We reserve the right to discontinue the Application or deny access for any reason without notice.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of South Dakota, United States, without regard to its conflict of law provisions.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and Swansons Bespoke Designs regarding the use of the Application.
